CONTRACT
By this Contract with Richard Gardner Photography (hereinafter Called ‘The Photographer’) it is mutually agreed that The Photographer shall provide services and/or goods as specified and that the Client shall pay the Photographer/s the amounts due for the said services and/or goods on the due date set out below.
Terms and Conditions of Wedding Contract
It is agreed that this contract will govern terms and conditions on which The Photographer will take images of the Client’s wedding and it is agreed for the sake of certainty that this contract together with any written representations made by The Photographer set out the total contract made between the parties. No variation or modification of this contract shall be effective unless agreed by both parties in writing.
1. Booking Fee
A booking fee of £100 ("The Booking Fee") is charged when the Client agrees to this contract. The Booking Fee is non-¬refundable. The Booking Fee is deducted (in full) from the total price agreed with The Photographer.
2. Payment
Following payment of the Booking Fee the remaining balance is due to be paid 30 days before the date of the wedding. Payment for additional products is to be made when they are ordered for the prices stated upon order. Additional products are not included in the agreed Price.
3. Usage of Images by The Photographer
The Clients hereby allow The Photographer to display any images relating to the Contract and to generally promote the Business in The Photographer’s portfolio and by means of advertising, publicity material, websites, exhibitions, competitions, social media, magazine articles, and other such media, providing that the images are used lawfully and without damage to the Client(s). By signing this contract you consent to the use of such images. The Photographer agrees not to resell any image to a third party other than with prior written consent.
4. Copyright
The entire copyright in the photographs is retained by The Photographer at all times throughout the world. Where a copy of photographs has been provided to the bride and groom as part of their wedding collection, these photographs may be printed, and displayed online, for personal but not commercial use.
5. Image Size, Colour, Style and Composition
The Photographer shall be granted full artistic licence during the production and post-production of the photographs, including artistic licence in the editing and selection of photographs. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record or print the exact colour as seen by the human eye.
Due to the vagaries of the weather and the willingness of the subject/s it may not be possible to capture all of the images requested by the Client.
If, for any reason, The Photographer reasonably deem it unreasonable in the circumstances to take the images which have been requested by the client then The Photographer shall exercise their right to take such images as they consider appropriate in the circumstances.
There is no right to reject on the basis of style, colour or composition.
Alteration of any images handed to the Bride and Groom is strictly forbidden by anyone other than the original photographer, If any re-edits are required after images are handed over 10 images can be re-edited free of charge after the 10 a charge £5 may be required for each additional image to be re-edited.
6. Attendance
In the unlikely event that the photographer is unable to complete the coverage due to unforeseen circumstances, the photographer reserves the right to appoint another photographer to attend on his behalf to undertake the photography or offer full refund.
7. Liability
The photographer takes the utmost care with respect to exposure, transportation and processing of photographic and video files. However, in the unlikely event of the Client’s photographs and/or video files being lost, stolen or destroyed for reasons within or beyond The Photographer’s control, the latter’s liability is limited to the return of all payments received for the event package.
Neither party shall be liable to the other for any losses that the other suffers as a result of the breach of the contract unless those losses are a foreseeable consequence of the breach. The Photographer/s cannot be held liable under this contract where the client is unhappy with the composition of any photographs where the Photographer/s have complied with his obligations.
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
8. Cancellation
8.1 The Client may cancel this contract at any time after it has been signed by sending a written notice to The Photographer.
8.2 If the Client notifies The Photographer more than 120 days before the date that the wedding is due to take place then The Photographer shall reimburse the Client the Whole of the price as is more particularly detailed in Clause
8.3 It the Client notifies The Photographer that they wish to cancel the contract at any time within three months of the date of the wedding then the amount of compensation that they shall receive shall be calculated as a proportion of the Price in accordance with the table below: (detailing the amount refunded to the Client).
0 - 7 days 0%; 8 - 14 days 5%; 15 - 30 days 10%; 30 - 60 days 20%; 60 - 120 days 50%; more than 120 days 100%
In the event of a Cancellation of this Contract all Booking Fees paid are non refundable.
PERSONAL DATA
Usage and Rights
1. You provide The Photographer explicit consent to contact you regarding the currently booked service and other potential services that we offer in order to conduct our business to the fullest of its ability.
2. You provide explicit consent for The Photographer to share personal data such as names and images to relevant suppliers in order to manufacture and create additional products that you may have ordered.
3. Your personal data such as name(s) and newly married name(s) may be used in areas such as The Photographer’s Website and associated advertisement material, social media websites, and any testimonials provided by the clients.
4. When supplying personal data from 3rd parties to T The Photographer you agree that you have gained explicit consent in which to do so and that they understand they can have their personal data reviewed, moved, or erased at any time.
5. No personal data stored by The Photographer of the client shall be given or sold to any 3rd parties who do not directly tie in with the day to day operation of Richard Gardner Photography and its business.
